Terms of Service

InstaBrain is an AI-powered mobile application and web service that transcribes, summarises, and generates structured insights from Instagram Reels. It is developed and operated by Yatinder Sharma ("we", "us", "our").

The service includes features such as AI analysis, a personal knowledge library, quiz generation, viral share cards, daily recall, and optional Pro subscription features.

• •You must be at least 13 years old (16 in the EEA) to create an account.
• •By using InstaBrain you represent that you meet this age requirement.
• •If you are under 18, you must have parental or guardian consent.
• •You must provide a valid phone number for authentication. One account per phone number.

You agree to use InstaBrain only for lawful purposes. You must not:

• •Submit Instagram Reels from private accounts without the owner's consent
• •Use the service to infringe copyright, trademarks, or other intellectual property rights
• •Attempt to reverse-engineer, decompile, or extract source code from the app
• •Use automated scripts, bots, or scrapers to access the service at scale
• •Share, resell, or sublicense access to the service to third parties
• •Attempt to circumvent subscription quotas or access Pro features without payment
• •Upload or process content that is illegal, harmful, or violates Instagram's Terms of Use
• •Harass, impersonate, or harm other users

We reserve the right to suspend or terminate accounts that violate these rules without notice.

Your Content

You retain ownership of any content you submit (reel URLs, personal notes, tags). By submitting content, you grant us a limited, non-exclusive licence to process that content solely to provide the service to you.

AI-Generated Output

Summaries, transcripts, quiz questions, and viral card text generated by our AI are provided for your personal use. We do not claim copyright over AI-generated outputs derived from your submitted content. You are responsible for verifying accuracy before relying on or sharing AI-generated content.

InstaBrain IP

The InstaBrain brand, logo, app design, and underlying software are the intellectual property of Yatinder Sharma. You may not use our brand assets without written permission.

Third-Party Content

Instagram Reels are owned by their respective creators and subject to Instagram's Terms of Use. InstaBrain is not affiliated with or endorsed by Instagram or Meta. You are responsible for ensuring you have the right to analyse any content you submit.

Free Tier

The Free tier is available at no charge and includes limited monthly quotas (25 analyses, 3 AI Insights, 5 quizzes per day). Quotas reset at the start of each calendar month.

Pro Tier

Pro is a recurring subscription that unlocks unlimited analyses, AI Insights, quizzes, OG image generation, and other premium features. Pricing is displayed in the app at the time of purchase.

• •iOS purchases are processed by Apple and subject to Apple's Standard EULA.
• •Android purchases are processed by Google Play.
• •Indian users may also subscribe via Razorpay on the web.
• •Subscriptions auto-renew at the end of each billing period unless cancelled at least 24 hours before renewal.
• •We do not issue refunds for partially used subscription periods except where required by law.

Cancellation

Cancel anytime through the platform you subscribed on (Apple, Google Play, or Razorpay dashboard). Access continues until the end of the current billing period.

Price Changes

We may change subscription pricing with at least 30 days' notice. Continued use after the change takes effect constitutes acceptance of the new price.

You may delete your account at any time by emailing support@instabrain.app with subject "Delete Account". We will process the deletion within 7 business days.

We may suspend or terminate your account if you violate these terms, engage in fraudulent activity, or if we discontinue the service. We will give reasonable notice where possible.

InstaBrain is provided "as is" and "as available" without warranties of any kind, either express or implied.

• •AI-generated transcripts, summaries, and insights may contain errors. Do not rely on them for medical, financial, legal, or safety decisions.
• •We do not guarantee continuous, uninterrupted access to the service. Downtime may occur for maintenance or technical reasons.
• •Analysis quality depends on the audio and visual clarity of the submitted reel. We do not guarantee that all reels will be successfully processed.
• •We are not responsible for content posted by Instagram users that you submit for analysis.

To the fullest extent permitted by applicable law, Yatinder Sharma shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use InstaBrain, including but not limited to loss of data, loss of profits, or reputational harm.

Our total liability for any claim arising out of or relating to these Terms shall not exceed the amount you paid us in the 12 months preceding the claim, or ₹1,000 (whichever is greater).

You agree to indemnify and hold harmless Yatinder Sharma from any claims, damages, or expenses (including reasonable legal fees) arising from: (a) your use of the service in violation of these Terms; (b) your violation of any third-party rights, including Instagram's Terms of Use; or (c) your submitted content.

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of India.

We encourage resolving disputes informally first — contact us at support@instabrain.app and we will make a good-faith effort to resolve the issue within 30 days.

We may update these Terms at any time. We will notify you of material changes by updating the effective date above and, where appropriate, by in-app notification. Continued use after the effective date of revised Terms constitutes your acceptance.
